Bail Month Fact #16 comes once again from a United States Department of Justice, Bureau of Justice Statistics Special Report published in 2008 entitled, Pretrial Release of Felony Defendants in State Courts. The study looked at State courts in the 75 largest counties in the country and assessed the effectiveness of various pretrial release mechanisms. They assessed failure to appear rates, recidivism rates and fugitive rates. This next Bail Month Fact is in regard to the fugitive research. Looking at the release mechanisms of those defendants who failed to appear in court and who were still fugitives after one year, it was determined that only 3% of those were released on a surety bond, while 18% were released on either unsecured bonds or own recognizance bonds. This once again proves the effectiveness at commercial bail in getting defendants to court, and demonstrates that when they don’t show up, the commercial bail industry goes and gets them.
