Domestic violence is one of those crimes that you hate hearing about, especially when it involves someone physically and/or emotionally hurting another person.  In many cases the victim doesn’t get any help or support and actually is the one that ends up arranging for a bail bond for the abuser to get them out of jail.  Even in the cases where the victim wants to get away from the abuser has a restraining order against them preventing any contact, they are never really safe.  It is in cases like this that you would hope the system could help and protect the victim.  But unfortunately in many of these situations, the victim doesn’t get the protection they need and the courts actually cause more harm than good.  Just check out this recent sad and ridiculous story out of Florida where a woman who was being attacked by her boyfriend tried to defend herself by firing a gun into the air twice.  This woman was under attack and being threatened by her boyfriend.  After breaking down the bathroom door to get her, the woman escaped into a garage.  She was able to find a gun and came out with it raised in the air.  When he approached her again, she fired two shots in the air to ward him off.  By the way, just as a back story…this man had beaten the woman several times previously including head butting her and beating her while she was pregnant.  He also had an injunction against him for previously hitting two women in the face because they wouldn’t “shut up.”

Believe it or not, this is where the story gets messed up.  Due to Florida’s ridiculous minimum sentencing laws, the woman was the one who was thrown in jail.  And she wasn’t just thrown in jail to cool off, she was thrown in jail for 20 YEARS!!!!  20 YEARS for trying to defend yourself from a documented abuser.  I don’t know about you, but it seems to me that judges need to use common sense in interpreting the law in cases like this.  Just because it says 20 years in black and white in the law, doesn’t mean that the judge can’t see the reality of the situation and use judgment in his decision.  When they say that justice is blind, they might also want to throw “irrational” in too.  What do you think?  Read the original story below.
