Today’s Bail Fact comes from a Special Report issued by the Departement of Justice Bureau of Justice Statistics. This special report, Pretrial Release of Felony Defendants in State Courts, was published in 2008 and looked at data collected over a 15 year period by the department. The data focused on pretrial releases occuring in 75 of the most populated metropolitan areas in the country. The study determined that of all the forms of release, that release on a commercial bail bond was the most effective mechanism for gauranteeing a defendant’s appearance in court. The study also determined that for those instances where a defendant failed to appear, commercial bail was the most successful mechanism for getting them back to court within a year. In fact, commercial bail was more than twice as effective as OR release and over 3 times as effective as release on an insecured bond through a pretrial services agency.
