The Bail Process:
The Bail Bondsman/Agency provides an insurance bond to the court to guarantee that the defendant will appear in court each and every time the judge/court requires them to.
For this service, the defendant and/or indemnitor/co-signer is charged a percentage of this bail amount (usually 10%), this is called the premium. The premium is NON-REFUNDABLE, it is the fee that is charged to write the bond.
Prior to the bond being written, the person that will be the indemnitor/co-signer will meet with the bail agent and sign a contract/agreement which states that the indemnitor/co-signer will be responsible for the defendant appearing at all of the required court appearances. If the defendant fails to appear at the required court appearance, the bond is then forfeited by the court at which time the indemnitor/co-signer is responsible for the full amount of the bond.
Collateral is sometimes required in addition to the premium. When the bond is discharged by the court, after the final court requirement is satisfied, the collateral is returned to the indemnitor/co-signer.
Indemnitor/co-signers typically need to have a steady job or constant source of legal income to show that they can pay the cost of the bond if it is forfeited.
If the defendant flees or 'skips' after being released on the bond, the indemnitor/co-signer is responsible for the full amount of the bond. If it becomes necessary to apprehend and surrender the defendant to the court, the indemnitor/co-signer will also be responsible for any fugitive fees/costs that the bail agency/agent incurs as permitted by law.
